Google Loses Appeal Against Competition Regulator
Pre-installation of entire Google Mobile System suite amounts to an abuse of dominant position, says NCLAT.
Google LLC’s anti-competitive policies case was decided on Wednesday by the National Company Law Appellate Tribunal, which upheld the order of the competition regulator with some modifications. “The NCLAT stated that the pre-installation of the entire Google Mobile System suite amounts to an abuse of dominant position.” Google’s argument that the Director General’s investigation was rife with confirmation bias was also rejected by the appellate tribunal. It claimed that the investigation did not violate natural justice principles.
The NCLAT ruled that Google must pay for abusing its dominant position. The appellate tribunal has thus confirmed the contention of the Competition Commission of India that the tech giant’s practices in the Android market were anti-competitive. The Rs 1,337-crorpenalty against Google has likewise been maintained by the re-appraising court.
