The United States Olympic and Paralympic Committee (USOPC) has filed a lawsuit against the Prime energy drinks brand, co-founded by popular YouTubers Logan Paul and KSI. The lawsuit, initiated in Colorado, accuses Prime of unauthorized use of trademarked Olympic phrases and symbols on a special edition of its hydration drink featuring NBA star and three-time Olympic gold medalist Kevin Durant.

The USOPC alleges that Prime’s actions were “deliberate” and conducted “in bad faith,” stating that the brand has used the Olympic terminology and trademarks without permission. The committee expressed concerns that consumers might mistakenly believe there is an endorsement or partnership between the USOPC and Prime. This legal action is part of the USOPC’s ongoing efforts to protect its intellectual property and maintain the integrity of the Olympic brand.

According to the lawsuit, which was reviewed by CBS News, the committee had previously issued a cease and desist letter to Prime, demanding the cessation of marketing activities using Olympic branding. However, Prime allegedly continued its promotional efforts, prompting the committee to take legal action.

The controversy surrounding Prime is not new. The brand has faced criticism for targeting a younger audience, leading to warnings and bans in some UK schools. The company’s energy drink, which contains high levels of caffeine, has been a particular point of contention. Earlier this month, US Senate Majority Leader Chuck Schumer called for an investigation into the brand’s caffeine content, raising further scrutiny.

Prime, which also offers a caffeine-free hydration drink, responded to these concerns by asserting its compliance with regulatory requirements in all operating countries. Despite the legal and regulatory challenges, Prime remains a prominent player in the market, leveraging the massive online followings of its founders, Logan Paul and KSI, who together boast over 40 million YouTube subscribers.

Since its launch in the UK in 2022, Prime has generated significant consumer interest, often leading to stock shortages and purchase limits in stores. The brand has successfully collaborated with major sports teams and athletes, including partnerships with Arsenal Football Club and the Los Angeles Dodgers.
